The United States is recognized as the most active jurisdiction worldwide in the prosecution of international corruption and transnational crime. What are the related challenges and lessons for (Brazilian) companies doing business internationally? This Workshop will offer insight on the US prosecutorial landscape for companies doing business in the US and internationally. Specifically, the Workshop will cover the touch points for the application of the FCPA, FCPA action by the US Department of Justice (DoJ) with a focus on Brazilian companies, recent changes in the DoJ’s Prosecutorial Guidelines, the Joint Chiefs of Global Tax Enforcement (“J5”) Initiative, Cross-Border Prosecutorial Cooperation and Challenges with the Assertion of the Attorney-Client Privilege, and Coordination with Foreign Governments and Regulators, and among US Authorities.
