Anatel Public Consultation | Fixed Broadband Data Cap


On November 11, 2016, the National Telecommunications Agency – Anatel – launched a new Public Consultation to collect technical subsidies in order to ground the Agency’s decision on fixed broadband data cap.

Anatel prepared a wide roll of questions – 29 in total, comprehending various aspects, to be answered in whole or in part. Contributions, combined with the information obtained from previous public consultations and hearings are part of Anatel’s process of assessment on a possible regulation, such as determined by Decision no. 151/2016.

The Decision, as a preliminary order, stays and prohibits reduction in speed or interruption in transmission of fixed broadband data by the companies that deliver such services, even if such conduct has been contemplated in the relevant contract. The preliminary decision will remain in force until new decisions are publicly announced by Anatel.

The Public Consultation will be available for 30 days, and contributions should be offered through Anatel website: http://www.anatel.gov.br/dialogo/groups/profile/895/tomada-de-subsidios-sobre-franquia-de-dados-na-banda-larga-fixa.
