President of the Republic signs, without vetoes, the new Telecommunications Law


The President of the Republic sanctioned, without vetoes, the New Telecommunications Law (Law n. 13.879/2019). Based on Chamber of Deputies Bill n. 79/2016, approved by the Senate, the law amends the Telecommunications Law to allow the adaptation of the telecommunications concession service modality for authorization, updating the legislation on the industry. It must be noted that unlike the concession contract, which requires a public bidding and cannot be broken unilaterally, the authorization modality does not provide for the need for public competition and may be revoked at any time by the Government.

With the modification provided for in article 1 of this law, all concession agreements between ANATEL and private telecommunications companies must establish the possibility of adaptation to the authorization modality. By means of this change, the economic value related to this migration should be reversed in investment commitments for the implementation of high capacity data transmission infrastructure, especially in less favored areas, with the objective of reducing regional inequalities and allow the Internet to be accessible to everyone in the Brazilian territory.
