Pernambuco and Minas Gerais advance in terms of Data Protection


The State of Pernambuco, on August 6, published the Decree No. 49,265/2020, which instituted the State Policy for Personal Data Protection of the State Executive Branch in accordance with Federal Law No. 13,709/2018 (“LGPD”). The Decree establishes the Four-Year Strategic Plan for Personal Data Protection (“PPDP”), which will be the instrument to establish priorities and implement data protection measures in the State. In addition, the Decree also contains provisions regarding the Governance of State Policy, the exercise of data subjects and the sharing of personal data between public entities. 

In the same regard, the Defender’s Office of the State of Minas Gerais issued Resolution No. 230/2020, also published on August 6, which instituted a Commission to analyze the implications of LGPD in the internal normative acts of the Defender’s Office and in the data stored in institutional systems and in the institutional activity. The Resolution establishes the purposes of the Commission, which shall especially analyze and map the impacts of LGPD in the institution, proposing appropriate changes. In addition, the Commission may propose internal regulations compatible with the rules of personal data protection.
