ICO imposes a fine of £ 80,000 to a company for unsolicited marketing calls


The British Personal Data Protection Authority (ICO) released, on August 3, 2020, a fine notice to Rain Trading Ld (RTL), company responsible for making 270,774 unsolicited direct marketing calls to subscribers registered with the Telephone Preference Service (TPS), without obtaining valid consent, during the period between January 1, 2018 and November 29, 2018. 

For the calculation of the penalty, ICO considered the complaints received as aggravating factors, in addition to the absence of an internal suppression list. According to ICO, making unsolicited direct marketing calls is an issue of great public concern and the imposition of fines should act as a general incentive of compliance with the law, or at least as a deterrent factor of such practices by companies that use direct marketing.
