In mid-April of this year, the district representative Julia Lucy (NOVO-DF) presented the Bill No. 1133/2020 which “provides for guidelines for guarantees of individual freedom and protection of personal data in intelligent monitoring to combat pandemics, and provides other measures”. The final draft of the project was approved by the end of June and published in the Official Gazette on July 8, 2020. Currently, the Bill waits for sanction or veto by the Governor of the Federal District. 

With highlight, the proposal brings two central objects: (i) the creation of the Intelligent Pandemic Monitoring System (SMIP), which enables access to peoples location data by mobile phones; (ii) the creation of the District Data Protection Authority (ADPD) and the District Data Protection and Privacy Council (CDPDP). In addition, in relation to the ADPD, it would be endowed with the power of inspection and punishment, including the conducts that violate the Brazilian General Data Protection Act (“LGPD”); it should be characterized by technical and decision autonomy; as well as respecting the LGPD and the Civil Rights Framework for the Internet.
